COMPETITION TERMS & CONDITIONS
Fishing Gear Showcase

§1
GENERAL

These Terms & Conditions, hereinafter the “Terms & Conditions,” define the rules, scope and terms of participation in the Fishing Gear Showcase Competition, hereafter the “Competition.”
The Competition is organized and the prizes are funded by Ten Square Games S.A. with its registered office in Wrocław, ul. Traugutta 45, 50-416 Wrocław, entered in the Register of Enterprises of the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, 6th Commercial Division of the National Court Register, under KRS number: 0000704863, with NIP number 8982196752, REGON number 021744780, with a share capital of PLN 733,482.20, hereinafter the “Organizer.”
The Competition will be held on the Organizer’s Facebook fan page under the name Ten Square Games.
The Organizer oversees the proper course and progress of the Competition, i.e., the communication of Competition information and the review of complaints.
The Competition starts on 22.02.2023 at 16:00 CET and ends at 02.03.2023 at 13:00 CET

§ 2
ACCEPTANCE OF THE TERMS & CONDITIONS AND PERSONAL DATA PROCESSING RULES

You enter the Competition on a voluntary basis and by doing so you confirm that you accept these Terms & Conditions, that you are familiar with the prize collection procedure, and that you agree to the processing of your personal data by the Organizer in accordance with the rules laid down herein.
If you meet the Competition eligibility requirement defined in § 3(3), this means that you have entered the Competition.

§ 3
COMPETITION ELIGIBILITY AND PARTICIPATION RULES

You may enter the Competition only if you are a natural person with a full capacity for legal transactions and are a registered Facebook user.
You undertake to comply with these Terms & Conditions and the Facebook Terms of Service.
To enter the Competition, submit a photo or a short video in a comment under the Competition post.
The photo or video must feature your favorite gear “in action” when used in the game.
The photo or video must be recent and must not include any prohibited elements or content not suitable for minors.
Additionally, you may, but are not required to, like the Organizer’s Facebook profile (this is not a Competition eligibility criterion).
Comments which do not meet the conditions stipulated in § 3(3) through § 3(5) above will not be considered.

§ 4
PRIZES

The following prizes can be won in the Competition:
Main prize: 5 × $100 Amazon Gift Card + 500 Pearls in Fishing Clash
Extra prize: 10 × $50 Amazon Gift Card + 100 Pearls in Fishing Clash
Winners have no right to exchange the prize for cash or any other prize.

§ 5
RULES OF CHOOSING WINNERS

To choose the winners, the Organizer shall appoint a Competition committee composed of three judges.
The Competition committee shall select 15 winners who have posted the most creative and inventive photo/video, with 5 to receive the main prize and 10 to receive the extra prizes.
The Competition winners will be informed about the result through Facebook in the comments under the Competition not later than on 03.03.2023 at 15:00 CET
The winners will be requested to send a private message to the Organizer to give their player ID and the email address where the prize is to be sent.
If a winner fails to provide the Organizer with information containing the email address where the prize is to be sent (i.e., fails to send a message), the prize will be awarded to the next person whose photo/video is found the most creative by the Competition committee.

§ 6
COMPLAINT PROCEDURE

You may file any complaints and objections regarding the course of the Competition in a private message to the Organizer on Facebook within 3 (three) days following the Competition end date. You will be informed how the complaint has been handled in a private message within 14 (fourteen) days after the Organizer receives your complaint.
A complaint should include at least your full name, a description of the problem and a proposed resolution.

§ 7
OBJECTIONS

You release Facebook from any liability for the Competition held by the Organizer.
The Competition is not created, administered, supported or sponsored by, or connected with, Facebook.

§ 8
PERSONAL DATA OF COMPETITION PARTICIPANTS

The Controller of your personal data is Ten Square Games S.A. with its registered office at ul. Generała Romualda Traugutta 45, 50-416 Wrocław. You may contact the Controller by sending an email to administracja@tensquaregames.com or by writing to the specified postal address.
The Organizer has appointed a Data Protection Officer, whom you can contact by sending an email to dpo@tensquaregames.com or by writing to the Controller’s registered office.
In connection with your participation in the Competition, your personal data will be processed for the purpose of:
allowing you to enter the Competition and sending you the prize should you win – the legal ground is the legitimate interest of the Controller which involves holding the Competition and selecting the winners,
reviewing complaints – the legal ground is the legitimate interest of the Controller which involves the need to take care of proper course of the Competition and ensure fair settlement of the results of the Competition,
the establishment or assertion or defense of any claims by the Controller – the legal ground for the data processing is the legitimate interest of the Controller which involves defending the Controller’s business interests.
Your personal data will be processed for the duration as required to award prizes in the Competition. The personal data retention period may be each time extended until the expiry of claims if the processing of personal data is necessary for the assertion or defense of any such claims by the Controller.
To the extent permitted by the law, you have the right to access your data, request their rectification, erasure or restriction of processing, as well as the right to object to the processing for reasons connected with your particular situation. Furthermore, you have the right to complain to the supervisory authority in charge of personal data protection in the member state of your habitual residence. In Poland, this authority is the President of the Personal Data Protection Office (Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warszawa).
You give your personal data freely but you are required to give them in order to enter the Competition. You cannot enter the Competition without giving your data.

§ 9
MISCELLANEOUS

The Competition Terms & Conditions are available on the Organizer’s Facebook fan page, where they can be downloaded at any time.
In matters not regulated herein, the provisions of the Polish Civil Code and other generally applicable laws of Poland shall apply.
